Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Gotchi ("the Software"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Software.

2. License Grant

Gotchi is released under the MIT License. You are granted a free, non-exclusive, worldwide license to use, copy, modify, and distribute the Software, subject to the terms of the MIT License.

3. User Responsibilities

You agree to:

  • Use the Software in compliance with all applicable laws and regulations
  • Not use the Software to generate illegal, harmful, or abusive content
  • Not attempt to reverse-engineer proprietary components, if any
  • Take responsibility for the outputs generated by AI models running on your hardware

4. Third-Party Models

Gotchi facilitates downloading and running third-party AI models. Each model is subject to its own license (e.g., Meta Llama License, Apache 2.0). You are responsible for complying with each model's license terms.

5. Paid Services

The Gotchi All-in-one subscription (€49.99/year) is billed annually and includes free updates for the duration of your subscription. You may cancel at any time; access continues through the end of your billing period. Refunds are available within 14 days of purchase.

6. Intellectual Property

The Gotchi name, logo, and branding are trademarks of Gotchi Labs. The open-source codebase is licensed under MIT. Content you create using Gotchi belongs to you.

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

8. Limitation of Liability

IN NO EVENT SHALL GOTCHI LABS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SOFTWARE, REGARDLESS OF THE THEORY OF LIABILITY.

9. Governing Law

These Terms are governed by the laws of the State of California, USA. Any disputes shall be resolved in the courts of San Francisco County.
